Although there is no universal definition regarding cyber-stalking, the term is generally used to refer to the use of the Internet, e-mail, or other telecommunication technologies to harass, communicate a threat or stalk another person. Likewise, most cyber-stalking laws, whether state or federal, also vary with respect to the elements that constitutes a criminal act.

Stalking is a crime that may carry a lasting social stigma as well as serious legal consequences. In some states, the laws governing stalking have become more rigid, and the punishment for a conviction can often be quite severe. General information about abuse
Many areas do not have laws that cover cyberstalking. In some areas, previously existing laws covering stalking were worded in such a way as to be applicable to cyberstalking, but if a law incorporates the requirement of close physical proximity, the law may not cover the situation.
For those in the U.S., the issue of "free speech" may become paramount when it comes to a cyberstalker or cyberharasser publishing about the victim.
Because cyberstalkers may hide behind anonymous or semi-anonymous remailers, law enforcement will require more sophisticated teams to track the cyberstalker.
Researchers found that 75 percent of the women in the study experienced controlling behavior during their former relationship with the stalker and that stalkers exercised control over their victims through financial, social, psychological, and physical acts. One fifth of the women said that their former partner had possessed a form of financial control over them. Sixty-one percent of the women had had restricted access to family members and friends. More than half of the women were psychologically abused, 65 percent reported physical abuse, and 9 percent experienced sexual abuse during their prior relationship with the stalker.
